TERMS AND CONDITIONS

THESE TERMS AND CONDITIONS CONSTITUTE AS AN AGREEMENT BETWEEN YOU AND PT. SOLUSI MEDIA SELULAR WHICH GOVERNS THE TERMS OF THE SERVICE AND APPLICATION (MOBILE ADVANTAGE ("MAD")) BY YOU. THIS AGREEMENT ALTOGETHER WITH ANY RENEWALS, ADDITIONAL TERMS, APPLICATION LICENCES AND POLICIES, COLLECTIVELY CONSTITUTE THE "AGREEMENT" BETWEEN YOU AND PT. SOLUSI MEDIA SELULAR. TO AFFIRM YOUR AGREEMENT WITH THESE TERMS, CLICK "OK". IF YOU DO NOT AGREE TO THESE TERMS, YOU DO NOT NEED TO CLICK "OK" AND YOU CAN NOT USE THE SERVICE. YOU MUST ACCEPT AND ABIDE BY THESE TERMS AS PRESENTED TO YOU; CHANGES, ADDITIONS, OR DELETIONS ARE NOT ACCEPTABLE, AND PT. SOLUSI MEDIA SELULAR HAVING DOMICILED AT THE EAST BUILDING, 33RD FLOOR SUITE #3301, JALAN LINGKAR MEGA KUNINGAN KAV E3.2 NO:1, JAKARTA INDONESIA ("SOLUSI"), MAY REFUSE YOUR ACCESS TO MAD FOR NON-COMPLIANCE WITH ANY PART OF THIS AGREEMENT.

DEFINITION OF SERVICE
MAD is a service provider for mobile advertisement and information ("Service") which enables you to obtain information and promotional/advertising materials, under the terms and conditions set forth in this Agreement.
AGE REQUIREMENTS IN USING THE SERVICE
This Service is available for all individuals. However, if you are under the age of 17, you should review these terms and conditions with your parent or guardian to make sure that you and your parent or guardian understand these terms and conditions and you must obtain written approval from your parent or guardian on your usage of MAD.
SYSTEM REQUIREMENTS
The usage of MAD or any other transactions done through MAD will abide to end-user agreements or the terms and conditions deemed necessary in connection with the utilization of application needed for the use of MAD and all the terms altogether shall constitute as a part of this Agreement.
Use of MAD requires one or more compatible devices, communication access and/or the internet and certain applications (additional cost may apply) and may require obtaining updates or upgrades from time to time. Because the use of MAD involves hardware, software, application and communication/internet access, your ability in using MAD may be affected by these factors.
You acknowledge and agree that fulfillment of such system requirements, which may be changed from time to time, is your responsibility. MAD is not part of any other product or proposal, and no purchase or obtaining of the product shall be construed to represent or guarantee your access to MAD.
YOUR INFORMATION
You agree to provide accurate, current, and complete personal data required to register with MAD and at other points as may be required in the course of using MAD ("Registration Data"). You further agree to maintain and update your Registration Data as required to keep it accurate, current, and complete. SOLUSI may terminate your rights to any or all of the Service if any information you provide is false, inaccurate or incomplete. You agree that MAD may store and use the Registration Data you provided.
USER ACCOUNT AND SECURITY
1. Account and Password.
  As a registered user of MAD, you may receive or establish an account ("Account"). You are solely responsible for maintaining the confidentiality and security of your Account. You should not reveal your Account information to anyone else or use anyone else's Account. You are entirely responsible for all activities that occur on or through your Account, and you agree to immediately notify SOLUSI of any unauthorized use of your Account or any other breach of security. SOLUSI shall not be responsible for any losses arising out of the unauthorized use of your Account.
2. Security.
  You understand that MAD will also include a security system which uses a certain technology which protects digital data and limits your use of the product so it is in accordance with the terms determined by SOLUSI ("Usage Rules"). You agree to abide by the Usage Rules as will be further stipulated and you agree not to violate or attempt to violate any element of the Security Framework. You agree not to attempt to, or encourage or assist any other person to, circumvent, modify, reverse-engineer, decompile, disassemble, or otherwise tamper with any part of the security framework used to administer the Usage Rules for any reason. Usage Rules may be controlled and monitored by SOLUSI for compliance purposes and SOLUSI reserves the right to enforce the Usage Rules with or without notice to you.
  You will not access MAD by any means other than through software that is provided by SOLUSI for the purpose of accessing MAD. You shall not access or attempt to access an Account that you are not authorized to access. You agree not to modify the software in any manner or form, or to use modified versions of the software, for any purposes including obtaining unauthorized access to the Service. Violations of system or network security may result in civil or criminal liability.
USE OF PRODUCT AND SERVICE
1. Products Requirements.
  You acknowledge that certain uses of content acquired of MAD may require the use of other hardware and software products or certain applications and that such hardware, software and application is your responsibility. Once MAD is licensed to you and you receive such content, it is your responsibility for any loss, destruction or damage of MAD and SOLUSI shall be without liability to you in the event of any loss, destruction, or damage.
2. To gain access to specific Services, you will be required to give information about yourself (e.g. identification or contact details) as a part of registration process of the Service or as a part of your continuous use of MAD. You agree that every registration information you provide to SOLUSI is always accurate, true and current.
3. You agree not to access (or attempt to access) MAD through means other than the interface that is provided by SOLUSI, unless you are specifically given authorization to do so stipulated in a separate agreement with SOLUSI.
4. You agree that you will not be involved in any activity that might result in the interference of MAD (or servers and networks connected to MAD).
5. Unless you are specifically authorized to do so in a separate agreement with SOLUSI, you agree that you will not reproduce, multiply, copy, sell, trade or resell MAD for any purposes.
6. You agree that your license of MAD constitutes your acceptance of and agreement to use MAD solely in accordance with the Usage Rules, and that any other use of the Products may constitute a copyright infringement. The security technology, if applicable, is an inseparable part of the Product. The Usage Rules shall govern your rights with respect to the Product, in addition to any other terms or rules that may have been established between you and another party. SOLUSI reserves the right to change or modify the Usage Rules at any time.
7. You acknowledge that some aspects of the Service, Product, and administering of the Usage Rules entails the ongoing involvement of SOLUSI. Therefore, if in any case, SOLUSI on its own decision changes or modifies a component of MAD or stops MAD, you acknowledge that you can no longer use MAD in the same manner as before the change or stop occurred and you acknowledge that SOLUSI shall not be subject to any liability.
8. You acknowledge and agree that in the mean time, SOLUSI has not yet determine the fixed limit of amount of transmission which you can obtain from MAD or of amount of memory space used in providing any Service, such limit may be determined from time to time by SOLUSI based upon its policy.
9. SOLUSI reserves the right not to post or publish any materials, to delete, remove or edit any material, at any time in its sole discretion without prior notice or liability.
UPGRADE
The latest version of the MAD application is recommended in order to access the Service. From time to time, an upgrade to the latest version of the MAD application may be required in order to undertake transactions on Service.
OBJECTIONABLE MATERIAL
You agree that by using MAD, you may encounter material that may be deemed offensive, indecent, or objectionable, which content may or may not be identified as containing explicit material. Nevertheless, you agree to use the Service at your sole risk and that SOLUSI shall have no liability to you for content that may be found to be offensive, indecent, or objectionable. Application types and descriptions are provided for your convenience and you acknowledge and agree that SOLUSI does not guarantee their accuracy.
You understand that all information (such as data file, written text, computer software, music, audio file or other sound, photo, video or other image) in which you can access is a part of, or through the use of MAD is solely the liability of the person from whence the content came. All information mentioned further will be referred to as content ("Content").
You must realize that the Content shown to you as a part of the Service, including but not limited to, advertisement in Service and Content sponsored within the Service may be protected by Intellectual Property Rights owned by the sponsor or the advertisement installer who provided the Content to SOLUSI (or by person or other company who is acting on behalf of them).
You are not entitled to modify, sell, distribute, or create derivative works based on the Content (wholly or partially) unless you have been specifically informed that you may do so by SOLUSI or the owner of the Content in a separate agreement.
SOLUSI has the right (but is not obligated to) filter beforehand, review, flag, waive, modify, reject or nullify every, or all Content of a Service. For some Service, SOLUSI may provide software to filter an explicit text Content. Services and applications which can limit your access to which you may feel objectable are available in markets.
You agree that you are fully responsible (and that SOLUSI can not be held responsible to you or the third party) for every Content you make, send or display when using the Service and for the consequences of such act (including the loss or damage suffered by SOLUSI), if there is any.
INTELLECTUAL PROPERTY
1. Acknowledgement of Ownership.
  You agree that MAD, including but not limited to Service, graphics, audio clips, and editorial content, contains proprietary information and material that is owned by SOLUSI and/or its licensors and is protected by applicable intellectual property and other laws, including but not limited to copyright and that you will not use such proprietary information or materials in any way whatsoever except for use of the Service in compliance with the terms of this Agreement. No portion of MAD may be reproduced in any form or by any means, except as expressly permitted hereunder.
  You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Service, in any manner, and you shall not exploit the Service in any unauthorized way whatsoever, including but not limited to, by trespass or burdening network capacity.
2. Copyrights.
  All copyrights in and to the MAD, including but not limited to the Service and application, are owned by SOLUSI, who reserve all of their rights in law and equity. THE USE OF ANY PART OF MAD, EXCEPT FOR USE OF THE SERVICE AS PERMITTED IN THESE TERMS OF SERVICE, IS STRICTLY PROHIBITED AND INFRINGES ON THE INTELLECTUAL PROPERTY RIGHTS OF OTHERS AND MAY SUBJECT YOU TO CIVIL AND CRIMINAL PENALTIES, INCLUDING POSSIBLE MONETARY DAMAGES, FOR COPYRIGHT INFRINGEMENT.
3. MAD Trademark, MAD logo, graphic and other MAD logos used in connection with the Service are trademarks or registered trademarks of SOLUSI in Indonesia. Other trademarks, service marks, graphics and logos used in connection with MAD may be the trademarks of their respective owners. You are granted no right or license with respect to any of the aforesaid trademarks and any use of such trademarks.
4. You acknowledge and agree that SOLUSI reserves all the right, property right legally of and for MAD, including every property right applicable for MAD (whether such right is registered or not and wherever such right may be in the world). Your further acknowledge that MAD may include information which is determined confidential by SOLUSI and that you may not reveal such information without prior written approval from SOLUSI.
5. SOLUSI grants you private license, in an international scope, royalty-free, non-transferable and non-exclusive license to use such materials as part of the Service provided to you by SOLUSI ("Application"). This license is solely for the purpose of your enjoyment of the Service provided by SOLUSI by means appropriated within the Terms and Conditions of the Agreement.
6. You may not (and permit another person) to copy, modify, make derivative works of, reverse-engineer, decompile or by any other means derive the source code from Application or every part of it, unless authorized by law or you are specifically noticed that you may do so by SOLUSI in writing.
7. Unless SOLUSI has granted written authorization to you to do so, you may not transfer (or give sub-license from) your rights to use the Application, granting security rights of your rights to use the Application or by any other means to transfer one part of your rights to use the Application.
ADVERTISEMENT DISPLAY
1. Part/All of the Service is supported by income from advertisements and may display advertisements and promotions. These advertisements are meant for the Content of information stored within the service, questions conveyed through the service or any other information.
2. Means, and method to as how far the advertisement from SOLUSI in the Service may be modified without prior notice to you.
3. As a compensation to access grant by SOLUSI to you to use the service, you agree that SOLUSI may install advertisement in the service.
OTHER CONTENT
You acknowledge and agree that SOLUSI is not responsible for the availability of the site or other sources and does not endorse every advertisement, product or any other material available from the web site or sources.
You acknowledge and agree that SOLUSI is not responsible for any loss or damage which you may bear as a result from the availability of the site or other sources or as a result from your dependability to the completeness, exactness or the existence of an advertisement, product or other material on or provided from the web site or sources.
CHANGES
SOLUSI may from time to time modify the Terms and Conditions. At the time such modification occurs, SOLUSI will make a new copy of the Terms and Conditions available in the SOLUSI web site address and every new additional condition will be provided to you from, within or through related services.
You understand and agree that in case you use the service after the date where the Terms and Conditions are amended, MAD will assume that your usage of the Service as an agreement to the new Terms and Conditions.
GENERAL CONDITIONS
1. The Terms and Conditions constitute the entirety of an agreement between you and MAD and stipulate the term of use of the service by you (not including every service that may be provided by MAD to you based on separate written agreement) and fully supersede every other agreement between you and MAD in accordance with the Service, if there is any.
2. You agree that MAD may deliver to you notices, including modification of conditions, through e-mail, mail, or placing it on the service.
3. You agree that in case SOLUSI fails to perform or implement a right or a remedy set forth within the conditions (or in case where SOLUSI gains favor by virtue of the prevailing law), then this shall not be deemed as a waiver of the right of SOLUSI and that such right or remedy is still available for SOLUSI.
4. If a court that has jurisdiction over the decision of such matter decides that a provision within this Terms and Conditions is invalid, therefore such provision will be nullified from the Terms and Conditions without giving effect to the other provisions. Other provisions of the Terms and Conditions prevail and shall be applicable.
5. Conditions and your relation with SOLUSI by virtue of the Terms and Conditions will be governed by the law of the Republic of Indonesia notwithstanding law conflict. You and MAD agree to abide by the exclusive jurisdiction of the Court in [***] Jakarta, DKI Jakarta to resolve every legal issue arising from the Terms and Conditions. Notwithstanding this, you agree that SOLUSI is still permitted to file an application for legal compensation (or any equal legal relief) in any jurisdiction.
TERMINATION
1. Termination may be conducted by SOLUSI if you fail to comply with any of the provisions of this Agreement, failure to provide SOLUSI with accurate and complete Registration Data, failure to safeguard your Account information, breach of the Usage Rules or any license to the software, or infringement or other breach of third parties' rights. MAD, at its sole discretion, without notice to you may: (i) terminate this Agreement and/or your Account; and/or (ii) terminate the license to the software; and/or (iii) preclude access to the Service or Product (or any part thereof).
2. Termination of the Service. MAD reserves the right to modify, suspend, or discontinue the Service (or any part or content thereof) at any time, without prior notice and MAD will not be liable to you or any other third party due to the conduct of this right.
GENERAL COMPLIANCE WITH LAWS
The Service is controlled and operated by PT. Solusi Media Selular from its office at The East Building, Lantai 33 SUITE #3301, Jalan Lingkar Mega Kuningan KAV 3.2 NO. 1, Jakarta. You agree to comply with all local, state, federal, and national laws, statutes, ordinances and regulations that apply to your use of the Service.
ENFORCEMENT OF THESE TERMS
SOLUSI reserves the right to take steps it believes to be reasonably necessary or appropriate to enforce and/or verify compliance with any part of this Agreement. You agree that SOLUSI has the right, without liability to you, to disclose any Registration Data and/or Account information to law enforcement authorities, government officials, and/or a third party.
NO RESPONSIBILITY FOR THIRD-PARTY MATERIALS
Certain Content, Products and services available via MAD may include materials from third parties. In addition, MAD may provide links to certain third party web sites. You acknowledge and agree that SOLUSI is not responsible for examining or evaluating the content or accuracy of any such third-party material or web sites. SOLUSI does not warrant or endorse and does not assume and will not have any liability or responsibility for any third-party materials or Web sites.
MAINTENANCE AND SUPPORT
SOLUSI will be solely responsible for providing any maintenance and support services with respect to its licensed Product, as specified in the applicable end-user license agreement, or as required under applicable law.
DISCLAIMER OF WARRANTIES
1. SOLUSI DOES NOT WARRANT THAT YOUR USE OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. YOU AGREE THAT FROM TIME TO TIME MAD MAY REMOVE THE SERVICE FOR INDEFINITE PERIODS OF TIME, OR CANCEL THE SERVICE AT ANY TIME WITHOUT PRIOR NOTICE TO YOU.
2. YOU AGREE THAT THE USAGE OF, OR THE INABILITY TO USE MAD IS SOLELY YOUR OWN RISK. THE SERVICE AND ADVERTISEMENT SENT TO YOU THROUGH MAD (UNLESS STATED EXPLICITLY OTHERWISE BY SOLUSI) IS GIVEN "LITERALLY" AND "AS HOW IT IS PROVIDED" AS AN INFORMATION, WITHOUT WARRANT OF ANY FORM, STATED EXPLICITLY OR IMPLICITLY, INCLUDING ALL IMPLICIT WARRANT FOR TRADE FEASIBILITY, COMPLIANCE WITH A PURPOSE, RIGHT AND CONTAINS NO VIOLATION.
3. PT. SOLUSI MEDIA SELULAR, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, PRINCIPALS AND LICENSORS CAN NOT BE HELD LIABLE FOR ANY CLAIMS ARISING OUT OF DIRECT OR INDIRECT DAMAGE, WHETHER IT IS INCIDENTAL, PUNITIVE OR SPECIFICALLY ARISING FORM THE USE OF MAD BY YOU, INCLUDING BUT NOT LIMITED TO, EVERY FAULT OR THE DELETION OF THE CONTENT, OR ANY LOSS IN ANY FORM ARISING AS A RESULT FROM THE USE OF CONTENT WHICH IS POSTED, DISTRIBUTED, OR AVAILABLE IN THE SERVICE, EVEN IF THE POSSIBILITY OF SUCH LOSS HAS BEEN STATED BEFOREHAND.
4. PT. SOLUSI MEDIA SELULAR SHALL USE REASONABLE EFFORTS TO PROTECT INFORMATION SUBMITTED BY YOU IN CONNECTION WITH THE SERVICE, BUT YOU ACKNOWLEDGE AND AGREE THAT YOUR SUBMISSION OF SUCH INFORMATION IS AT YOUR SOLE RISK, AND SOLUSI HEREBY DISCLAIMS ANY AND ALL LIABILITY TO YOU FOR ANY LOSS OR LIABILITY RELATING TO SUCH INFORMATION IN ANY WAY.
5. SOLUSI DOES NOT WARRANT THAT THE SERVICE WILL BE FREE FROM LOSS, CORRUPTION, ATTACK, VIRUSES, INTERFERENCE, HACKING, OR OTHER SECURITY INTRUSION, AND SOLUSI DISCLAIMS ANY LIABILITY RELATING THERETO. THE PRODUCT CAN ONLY BE DOWNLOADED ONCE; AND AFTER THE DOWNLOAD IT CAN NOT BE REPLACED IF LOST BECAUSE OF WHATEVER REASON. YOU SHALL BE RESPONSIBLE FOR BACKING UP YOUR OWN SYSTEM, INCLUDING ANY PRODUCTS PURCHASED FROM THE SERVICE THAT ARE STORED IN YOUR SYSTEM.
6. SPECIFICALLY, PT. SOLUSI MEDIA SELULAR AND ITS AFFILIATES AND LICENSORS DO NOT DECLARE OR GUARANTEE YOU THAT:
  1. THE USE OF SERVICE BY YOU WILL FULFILL YOUR CONDITIONS,
  2. THE USE OF SERVICE BY YOU WILL NOT BE UNINTERRUPTED, SAFE OR ERROR-FREE,
  3. EVERY INFORMATION OBTAINED BY YOU AS A RESULT OF THE USE OF THE SERVICE IS ACCURATE, AND
  4. DEFECTS IN OPERATION OR FUNCTIONALITY OF AN APPLICATION PROVIDED TO YOU IS AS A PART OF THE SERVICE THAT WILL BE REPAIRED.
ALL MATERIALS INSTALLED OR BY ANY OTHER MEANS OBTAINED THROUGH THE USE OF SERVICE ARE PERFORMED ON YOUR OWN DISCRETION AND RISK AND YOU ARE SOLELY RESPONSIBLE ON ANY DAMAGE OCCURING ON YOUR MOBILE PHONE, COMPUTER SYSTEM OR ANY OTHER EQUIPMENTS OR ANY LOSS OF DATA CAUSED BY THE INSTALLATION OF THE SAID APPLICATION.
LIMITATIONS OF LIABILITY
IN ACCORDANCE WITH THE ENTIRETY OF THE TERMS WITHIN ARTICLE 19 ABOVEMENTIONED, YOU UNDERSTAND AND AGREE THAT PT. SOLUSI MEDIA SELULAR AND ITS AFFILIATES, ALSO LICENSORS SHALL NOT BE LIABLE FOR:
1. THE COMPENSATION OF DIRECT, INDIRECT, INADVERTENT, SPECIFICALLY OR AS AN EXAMPLE OF WHICH YOU CAN BEAR, WHATEVER THE CAUSE; INCLUDING BUT NOT LIMITED TO, EVERY LOSS OF PROFIT (DIRECTLY OR INDIRECTLY), EVERY LOSS OF GOODWILL OR BUSINESS REPUTATION, EVERY LOSS OF DATA SUFFERED, PROCUREMENT COSTS OR SUBSTITUTE SERVICE, OR OTHER IMMATERIAL LOSS;
2. EVERY LOSS OR DAMAGE IN WHICH YOU CAN BEAR INCLUDING BUT NOT LIMITED TO, LOSS OR DAMAGE AS A RESULT FROM:
  1. YOUR DEPENDENCE TO THE COMPLETENESS, ACCURACY OR THE EXISTENCE OF AN ADVERTISEMENT, OR AS THE RESULT OF A RELATION OR TRANSACTION BETWEEN YOU AND THE ADVERTISEMENT INSTALLER OR SPONSOR WHICH ADVERTISEMENT IS SET FORTH IN THE SERVICE;
  2. A CHANGE WHICH CAN BE DONE BY SOLUSI OF THE SERVICE OR FOR THE END OF EVERY SERVICE PERMANENTLY OR TEMPORARILY (OR A FEATURE IN THE SERVICE);
  3. DELETION FROM, DAMAGE FROM, OR FAILURE TO STORE THE CONTENT AND OTHER COMMUNICATION DATA MANAGED OR SUBMITTED BY OR THROUGH THE USE OF THE SERVICE BY YOU;
  4. YOUR FAILURE TO GIVE AN ACCURATE ACCOUNT INFORMATION TO SOLUSI;
  5. YOUR FAILURE TO WITHHOLD SECRECY AND SAFETY OF YOUR PASSWORD OR ACCOUNT;
THE LIMITATION OF PT. SOLUSI MEDIA SELULAR ABOVE APPLIES, WITHOUT HAVING THE NEED OF PRIOR CONFIRMATION FROM PT. SOLUSI MEDIA SELULAR CONCERNING THE POSSIBILITY OF LOSSES THAT MAY ARISE.
CHANGES
SOLUSI reserves the right, at any time and from time to time, to update, revise, supplement, and otherwise modify this Agreement and to impose new or additional rules, policies, terms, or conditions on your use of the Service. Such updates, revisions, supplements, modifications, and additional rules, policies, terms, and conditions (collectively referred to in this Agreement as "Additional Terms") will be effective immediately and will be incorporated into this Agreement. Your usage of the Service will be seen as your agreement to be governed to all the Additional Terms. All of the Additional Terms will be included within this Agreement based on this article.
NOTICES
SOLUSI may send you notice with respect to the Service by sending an e-mail message to the e-mail address listed in your Account contact information, by sending a letter via postal mail to the contact address listed in your Account contact information, or by a posting on the Service. If SOLUSI do not have the email address of the member on SOLUSI's list, therefore SOLUSI will give the notification through the menu. Notices shall become effective immediately.
GOVERNING LAW
This Agreement and the use of the Service is governed by the law of the Republic of Indonesia, including but not limited to the Law Number 40 Year 1999 concerning Press, the provisions governing conflict of law, governs the Terms and Conditions from the Service and also your use of the Service. You acknowledge that exclusive jurisdiction for every claim or dispute with MAD or related with your usage of the Service will be settled at the Court in Jakarta.
MISCELLANEOUS
These Terms and Conditions constitute the entire agreement between you and SOLUSI and govern your use of the Service, superseding any prior agreements between you and SOLUSI. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content, or third-party software. In a case a provision within this Terms and Conditions becomes invalid or can not be applied, such part will be interpreted with ways in accordance with the existing law in order to reflect, as close as possible, the will of the parties and all the other terms shall prevail.

Failure to enforce any right or provisions in these Terms and Conditions will not constitute a waiver of such provision, or any other provision of these Terms and Conditions. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the other provisions will remain in full force and effect. SOLUSI will not be responsible for failures to fulfill any obligations due to causes beyond its control.

MAD is not responsible for error in typography.
